Terms of Service

Effective: 2026-07-15 Version: 1.0 App: Esha Operator: Solo individual (not a company). Operator legal name: Phanidhar Rao Madduri (sole proprietor), India. Operator country of residence: India. Governing law: Laws of India (specifically the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019, and the Indian Contract Act, 1872), excluding conflict-of-laws rules. Disputes that cannot be resolved by good-faith negotiation will be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India. Support / legal contact: support@askesha.com (at v1.0 the operator uses a personal mailbox; once a custom-domain mailbox support@askesha.com is provisioned, these Terms will be updated and existing users notified per §19).

Drafting note for the operator: These Terms of Service are written to match the actual functionality of Esha at version 1.0. Phase 4.15.G G.64 has filled the operator-provided values (legal name + support email) and bumped the user-age floor to 18 to align with India DPDP 2023 §9(1) and the adult-targeted nature of the content. The document should still be reviewed by qualified counsel admitted in India before publication, and checked against current App Store Review Guidelines and Google Play Developer Program Policies before submission.


1. Acceptance and eligibility

By creating an account or using Esha, you agree to these Terms. If you do not agree, do not use Esha.

You may use Esha only if all of the following are true:

  1. You are at least 18 years old. This single floor satisfies India DPDP 2023 §2(f) + §9(1) (verifiable parental consent for under-18s), the highest GDPR member-state digital-consent ceiling (16, in DE and NL), and is also above the US COPPA threshold (13) for the adult-targeted content this app provides.
  2. You are not legally barred from using the service in your jurisdiction.
  3. You are using the service for personal, non-commercial reflection.

We enforce the minimum-age rule at registration. If we learn that an account was created in breach of this section, we will delete it.

These Terms operate alongside the Privacy Policy, which is incorporated by reference.


2. What Esha is — and what it is not

Esha is an AI-assisted astrology companion. It calculates a Vedic astrological chart from the birth details you provide, and it lets you chat with an AI grounded in that chart for personal reflection.

Esha is not:

You should treat Esha as a reflective tool, not as an authority on your life. Decisions you make after using Esha are your own.


3. Your account

You provide an email address and a password to create an account. You agree to:

We may suspend or terminate accounts that violate these Terms, abuse rate limits, attempt to bypass the AI safety layer, or exhibit fraud or security-risk behavior.


4. Subscriptions, free trial, billing

Esha is freemium. Tiers at version 1.0:

4.1 Where billing happens

All paid subscriptions are processed by Apple App Store, Google Play Store, or RevenueCat, depending on the platform. We do not collect or store your payment-card details. The pricing, currency, taxes, and renewal cadence shown to you are governed by your chosen app store and your local rules.

4.2 Free trial

We offer a 30-day free trial of paid features at version 1.0. The trial begins when you start it. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription at the price shown when you started the trial, charged by Apple or Google, and will renew automatically until you cancel.

4.3 Auto-renewal and cancellation

Paid subscriptions auto-renew at the end of each billing period unless you cancel them through your Apple ID Subscriptions settings (iOS) or your Google Play subscriptions management page (Android), or via RevenueCat where applicable. Cancellation takes effect at the end of the current billing period.

4.4 Refunds

Refunds are handled by the app stores under their own policies:

We do not issue refunds outside the app-store mechanisms.

4.5 Changes to pricing

If we change subscription prices, the change applies to billing periods that begin after we notify you, never to a billing period already paid for.


5. Acceptable use

You agree not to:

  1. Use Esha to make decisions about medical conditions, treatment, or medication.
  2. Use Esha as a substitute for legal, financial, or professional advice.
  3. Submit content intended to harm another person, threaten violence, harass, defame, or extort.
  4. Submit content that includes another person's private information, including their birth data, without their permission.
  5. Try to bypass our safety layer — for example, by re-phrasing requests for the date of someone's death, exact marriage timing, fertility prediction, or deterministic disease prediction.
  6. Try to extract our system prompts, internal instructions, or proprietary chart-validation rules.
  7. Reverse-engineer, decompile, or scrape Esha, except as expressly allowed by applicable mandatory law.
  8. Send automated traffic to our API outside of the app, abuse rate limits, or attempt to overwhelm the service.
  9. Resell, sublicense, or commercially redistribute Esha's outputs without our written consent.
  10. Use Esha in any jurisdiction where it is unlawful for you to do so.

We may remove content, restrict features, or terminate accounts that violate this section.


6. AI replies and the nature of astrology

Esha uses a third-party AI provider (currently OpenAI) to generate responses, layered on a deterministic Vedic chart-calculation engine. You should understand the following before relying on any reply:

  1. AI may be wrong. AI replies may be inaccurate, incomplete, biased, outdated, or unsuitable for your situation, even when our validation layers approve them.
  2. Astrology is not deterministic. Esha may describe windows of activation, recurring patterns, or dasha context. It does not promise a specific date for any real-world event. We technically prevent this by:
    • Refusing user prompts that ask for the date of marriage, the date of someone's death, fertility prediction, or deterministic disease prediction.
    • Validating every AI reply against a fact contract that rejects deterministic event-timing claims; replies that fail validation are regenerated.
  3. No guaranteed outcomes. Nothing Esha tells you is a promise about the future.

Esha is reflective content for your personal use. It is not professional advice and you should not use it as the sole basis for any significant life decision.


7. No medical, legal, financial, or psychological advice

Esha does not provide and is not intended to provide:

If you nonetheless rely on Esha for any of the above, you do so at your own risk and contrary to these Terms.


8. Crisis and safety

If you indicate intent or thoughts of self-harm or suicide, Esha will replace the astrology reply with a crisis response listing helplines:

Esha cannot replace emergency services. If you are in immediate danger, call your local emergency number now.

By using Esha, you agree that the above safety routing is the only form of crisis-related response Esha will provide; we do not provide ongoing counselling, escalation to a clinician, or any monitored intervention.


9. Your content and the license you grant us

You retain ownership of:

To make Esha work, you grant us a worldwide, royalty-free, non-exclusive license to host, process, transmit, and display your content only as needed to operate, secure, support, and improve the service. We use this license, for example, to:

This license ends when you delete the relevant content (a chat, a profile, or your entire account), except for backups that roll off naturally and aggregated, non-identifiable usage totals.

We do not use your content to train AI models, sell to data brokers, or target third-party advertising. See the Privacy Policy for the full list of what we do and do not do with your data.


10. Our intellectual property

Esha, its name, logo, app, source code, deterministic Vedic engine, validator rules, system prompts, fact-grounding contracts, in-app artwork, daily-content templates, and all other product elements are owned by the operator and protected by copyright, trademark, and other intellectual-property laws.

We grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the app on devices you own or control, for personal, non-commercial reflection only. No other rights are granted.

You may not:


11. Privacy

Your use of Esha is also governed by the Privacy Policy. The Privacy Policy describes what we collect, how we use it, the third-party providers we rely on (OpenAI, Railway, Apple/Google, RevenueCat, Sentry where enabled, Expo Push), how long we retain data, and how to exercise your rights.

If there is a conflict between these Terms and the Privacy Policy regarding privacy matters, the Privacy Policy controls.


12. Service availability, changes, and beta features

We aim to keep Esha available, but we do not promise uninterrupted service. We may modify, pause, or discontinue any feature at any time, including for maintenance, security, legal compliance, or because we no longer wish to operate it. Where reasonable, we will give advance notice through the app or the support address.

We may release features marked as beta, preview, or experimental. These may be unstable, may change without notice, and are provided as-is even where the rest of the service has stricter standards.

We are a single-operator product. We do not offer service-level agreements, uptime guarantees, or 24×7 support at version 1.0.


13. Termination

13.1 Termination by you

You may stop using Esha at any time. To remove your data, delete your account (Section 14).

13.2 Termination by us

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have:

We may also terminate accounts in bulk if we discontinue the service.

Termination by us does not entitle you to a refund except where required by mandatory consumer-protection law.

13.3 Effect of termination

Sections that should reasonably survive termination — including Sections 7 (no professional advice), 9 (license you grant us, with the deletion effect noted), 10 (our IP), 15 (disclaimers), 16 (liability cap), 17 (indemnity), 20 (governing law), and 21 (miscellaneous) — survive termination of these Terms or your account.


14. Account deletion and data export

You can:

Deleting your account does not cancel a paid subscription. Cancel the subscription in your Apple or Google account before deleting the Esha account, or you may continue to be billed by the app store.


15. Disclaimer of warranties

To the maximum extent permitted by law:

Esha is provided "as is" and "as available," without warranty of any kind, express, implied, or statutory. We expressly disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, security, and that Esha or its outputs will meet your expectations or be free of errors.

We make no warranty that:

Where mandatory consumer-protection law in your jurisdiction grants warranties that cannot be waived, those warranties apply and the disclaimer above is read narrowly to leave them intact.


16. Limitation of liability

To the maximum extent permitted by law:

In no event will the operator be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, opportunities, goodwill, or anticipated savings, arising out of or related to Esha or these Terms — even if we have been advised of the possibility of such damages, and regardless of the legal theory.

The operator's total cumulative liability arising out of or related to Esha or these Terms is limited to the greater of (a) the total amount you have paid the operator for Esha in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 50.

This limit applies in aggregate, not per claim.

In jurisdictions that do not allow exclusion or limitation of certain damages, the exclusions and limitations above apply only to the maximum extent permitted in that jurisdiction. Nothing in these Terms excludes liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or anything else that cannot be excluded by law.


17. Indemnity

You agree to indemnify and hold the operator harmless from any third-party claim, demand, loss, or damages (including reasonable attorneys' fees) arising out of:

This indemnity does not apply to the extent the claim arises from our own willful misconduct or gross negligence, or where indemnification by a consumer is prohibited by mandatory local law.


18. Apple App Store and Google Play

18.1 Apple-specific terms (iOS users)

If you downloaded Esha from the Apple App Store, the following apply:

18.2 Google Play-specific terms (Android users)

If you downloaded Esha from Google Play, your use is also subject to the Google Play Terms of Service and the Google Play Developer Distribution Agreement (between the operator and Google). The operator, not Google, is responsible for Esha. Google is not a party to these Terms.

You can manage subscriptions, request refunds, and delete your Google Play purchase history through Google Play. Account deletion is also available from the public page at https://askesha.com/delete-account.


19. Changes to these Terms

We may update these Terms. The effective date at the top changes when we do. Material changes — for example, changes to subscription terms, refund handling, the limitation of liability, or the dispute-resolution clause — will be communicated in-app or to your account email before the change takes effect.

If you continue to use Esha after a change takes effect, you accept the updated Terms. If you do not accept them, stop using the service and delete your account.


20. Governing law and disputes

These Terms are governed by the laws of India, specifically the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019, and the Indian Contract Act, 1872, in each case excluding their conflict-of-laws rules.

Disputes arising out of or relating to Esha or these Terms will be resolved in the competent courts of Hyderabad, Telangana, India, except that you may bring a small-claims action in your local jurisdiction where permitted by law, and except where mandatory consumer-protection law in your jurisdiction guarantees you the right to bring proceedings in your home country.

If your home country's law gives you protections that cannot be waived (for example, certain EU consumer rights, India consumer-protection rules, or US state-level consumer rights), nothing in this section reduces those protections.

We do not require binding arbitration at version 1.0. If we add an arbitration clause in a future version, we will give you advance notice and the right to opt out.
